The verdict was read out by the foreman (Mr W Page - schoolmaster) as follows:"We unaminously find that the deceased, Joshua Rigby, was murdered by being struck on the head by some heavy instrument, and we agree that there is sufficient evidence to have John Gibbons tried at a superior court."⁵
Biography	17 October 1883	John was charged with the wilful murder of his uncle on the 18th September 1883. He was defended by a well-known Bolton solicitor, named Richardson, who was nicknamed, 'Fat Dick' by frequenters of the Police Courts, because of his tall and slim proportions. Mr Cobbett, barrister, of Manchester, represented the Treasury. At the end of the proceedings John was committed to Kirkdale Jail (Liverpool) to await trial on the charge of murdering his uncle.

Lowther, instructed by Mr Cobbett, were the prosecuting council, and Mr Atkinson, with Mr Wharton, instructed by Mr Richardson appeared for the defence.At the trial Mr Atkinson used the same arguments, and adopted a similar line of defence that Mr Richardson used at Leigh Police Court. During the afternoon one of the jury men was suddenly taken ill and had to retiire, which brought the proceedings for the day to a close.⁵
Biography	19 November 1883	On the following day, the juryman being still too sick to appear, the judge and counsel had a private consultation, after which the judge advised a verdict of not guilt, stating that on the evidence advanced, no jury would convict.John returned home that evening.⁵
